Quoting A Copyrighted Work

I am not a lawyer, this is NOT legal advice…

I wanted to utilise a quotation from a book for one of my 150-word articles, so I did a bit of research into the Fair Use Doctrine.

When re-using copyrighted material (in this case, using a quotation from the book) these are some questions:

  1. Is your use for “purposes such as criticism, comment, news reporting, teaching, scholarship, or research”?
  2. Is the purpose and character of the use commercial?
  3. Is the nature of the underlying work highly creative?
  4. How much of the copyrighted material did you use?
  5. Will your use of the quote cause the author to lose money?

Answers:

  1. Using it for comment
  2. It is commercial (as I am on the MPP)
  3. Yes, therefore strong copyright protection
  4. 38 Words
  5. Unlikely — people should go and buy this book now

Hopefully, I am in the clear.
