Quoting A Copyrighted Work
I am not a lawyer, this is NOT legal advice…
I wanted to utilise a quotation from a book for one of my 150-word articles, so I did a bit of research into the Fair Use Doctrine.
When re-using copyrighted material (in this case, using a quotation from the book) these are some questions:
- Is your use for “purposes such as criticism, comment, news reporting, teaching, scholarship, or research”?
- Is the purpose and character of the use commercial?
- Is the nature of the underlying work highly creative?
- How much of the copyrighted material did you use?
- Will your use of the quote cause the author to lose money?
Answers:
- Using it for comment
- It is commercial (as I am on the MPP)
- Yes, therefore strong copyright protection
- 38 Words
- Unlikely — people should go and buy this book now
